Terms of Service

These terms govern access to and use of the Aholler AI receptionist platform.

1. Agreement

By creating an account, joining a workspace, purchasing a subscription, or using Aholler, you agree to these Terms of Service and the Privacy Policy. If you use Aholler for an organization, you represent that you are authorized to accept these terms for that organization.

2. The service

Aholler provides tools for configuring AI receptionists, handling telephone calls, generating transcripts and summaries, qualifying leads, reviewing analytics, routing follow-up, and creating confirmed calendar appointments. Features may depend on third-party voice, telephony, calendar, payment, messaging, or hosting providers.

3. Accounts and workspace administration

  • You must provide accurate account information and keep credentials confidential.
  • Workspace owners and administrators control members, agents, integrations, phone lines, and business data.
  • You are responsible for activity performed through your account and for promptly reporting suspected unauthorized access.
  • You may not share access in a way that bypasses plan limits or security controls.

4. Customer responsibilities

You are responsible for your use of Aholler, including:

  • Obtaining necessary rights and lawful bases for contact data, calls, recordings, transcripts, messages, and knowledge content.
  • Providing required AI, recording, and privacy disclosures and obtaining consent where applicable.
  • Following telemarketing, do-not-call, calling-hour, consumer-protection, employment, healthcare, and industry-specific requirements that apply to your organization.
  • Reviewing agent prompts, routing, business information, calendar rules, and outputs before production use.
  • Maintaining appropriate human escalation and follow-up for sensitive, urgent, or high-impact matters.

5. AI limitations

AI-generated speech, transcripts, summaries, classifications, recommendations, and tool calls may be incomplete or inaccurate. Aholler is not an emergency service and must not be relied upon as the sole system for medical, legal, financial, safety-critical, or emergency decisions. You must evaluate whether human review is appropriate for your use case.

6. Acceptable use

You may not use Aholler to:

  • Violate law, privacy rights, intellectual-property rights, or provider policies.
  • Conduct fraud, harassment, impersonation, deceptive calling, unlawful surveillance, or unauthorized marketing.
  • Transmit malware, attempt unauthorized access, disrupt the service, or bypass usage and security restrictions.
  • Collect highly sensitive information unless your organization has implemented appropriate legal, contractual, and technical safeguards.
  • Represent AI-generated statements as guaranteed professional advice or confirmed actions when the service reports a failure.

7. Subscriptions, usage, and payment

Paid features are provided according to the selected plan, included usage, and prices displayed at checkout or agreed in writing. Subscriptions may renew automatically until canceled. Taxes, telecommunications charges, overages, and third-party charges may apply where disclosed. Payments are processed by Stripe, and billing changes may take time to synchronize after provider delivery.

8. Customer content and integrations

You retain ownership of content you submit. You grant Aholler the limited rights necessary to host, process, transmit, and transform that content to provide and secure the service. You represent that you have the rights required to provide the content.

When you connect a third-party service, you authorize Aholler to access and use that service only as needed for the enabled feature. Third-party services remain governed by their own terms and may change, suspend, or discontinue functionality.

9. Aholler technology

Aholler and its licensors retain all rights in the platform, software, interfaces, designs, documentation, and related technology. Except for the limited right to use the service under these terms, no rights are transferred to you.

10. Availability and changes

We work to keep Aholler available and reliable, but do not guarantee uninterrupted or error-free operation. We may modify features, apply limits, perform maintenance, or suspend access when reasonably necessary for security, legal compliance, provider requirements, nonpayment, or material violation of these terms.

11. Termination

You may stop using Aholler or cancel a subscription through available billing controls. We may suspend or terminate access for material breach, unlawful use, security risk, or nonpayment. Upon termination, access may end immediately and data will be handled according to the Privacy Policy, contractual commitments, and applicable law.

12. Disclaimers

To the maximum extent permitted by law, Aholler is provided on an "as is" and "as available" basis. We disclaim warranties not expressly stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and that AI or third-party provider outputs will always be accurate, available, or suitable for your business.

13. Limitation of liability

To the maximum extent permitted by law, Aholler will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities arising from the service. Any aggregate liability will not exceed the amount paid for the service during the twelve months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply.

14. Changes and contact

We may update these terms as the service or law changes. Continued use after an effective update constitutes acceptance where permitted by law. Questions may be sent to support@aholler.ai.
